Domain registration terms
These terms apply when you register, renew or manage a .hk or .com.hk domain name through eComGear. They are part of our Terms of Service. By ticking the agreement boxes at checkout you accept them.
1. Domain registration agreement
eComGear is a service partner of the .hk registry. We take your order, pass it to the registry, and look after payment, reminders and support. The domain is registered in the name of the registrant you give us (a company or a person). It is not registered to eComGear.
A registration is a one-year right to use the name, not ownership of it. It starts only when the registry confirms that it is active. Until then the name is not yours, and the registry may refuse the application.
You confirm that you are the registrant or are authorised to act for the registrant, that every detail you give is true and complete, and that you will keep it up to date. You agree to follow the registry's rules and policies as they change from time to time, and not to use the name for anything unlawful, abusive or misleading.
2. Who can register, and documents
A .hk name can be registered by a person aged 18 or over, or by an organisation. A .com.hk name is for a business registered in Hong Kong and needs its business registration number. A person cannot register a .com.hk name.
We take payment first and collect documents afterwards. The registry may ask for proof, such as an ID document for a person or a business registration certificate for a company. We will tell you what is needed and by when. If the proof is not supplied, or does not match what you told us, the registry can reject the application.
We keep the documents you send until 12 months after the domain is deleted or the application is rejected, and use them only to deal with the registry and to meet legal duties.
3. Price, payment and refunds
Prices are in Hong Kong dollars and are shown before you pay. A launch price may apply to the first year only. Renewals are charged at the price we publish at the time, and we tell you before we charge.
Payments are taken by Stripe. A checkout you do not finish expires after a short time and the name is released.
If the registry, or our review, rejects your order for a reason that is not your fault, we refund you in full. We do not refund when the registry rejects the application because the information or documents you gave were incomplete or inaccurate. For any other refund request, write to us and we will look at it case by case.
4. WHOIS notice and your details
As its rules require, the registry publishes some registrant details in a public domain directory (WHOIS). What is shown depends on the registry's policy and may include the registrant name, the contact email, the domain's dates and its name servers. By registering a name you accept that publication.
We pass your registrant and contact details to the registry to register the name, and we keep them on file to support you. We do not sell them. Our Privacy Policy explains how we handle personal data.
5. The registry is independent
The registry is an independent organisation and not part of eComGear. Its rules, fees, decisions and downtime are outside our control. If it rejects, suspends, cancels or transfers a name, or if a dispute under its policy affects the name, we follow its decision and are not liable for it.
The registry's dispute policy lets others challenge a name. If a challenge succeeds, the name can be transferred or cancelled.
6. Renewal, expiry and auto-renew
Auto-renew is off unless you turn it on with its own tick. If you do, we charge the saved card about 14 days before expiry, retry 10, 7, 3 and 1 days before, and remind you beforehand. You can turn it off at any time. We never renew without your consent.
A domain that is not renewed expires, and the registry's grace and redemption rules then apply. Getting it back may cost extra or be impossible, so renew early. Keep your email address up to date: reminders and registry notices are sent there.
7. Transfers, changes and ending
You manage the name servers and DNS records from your dashboard. Transfer authorisation codes, changes of the registrant (holder) and deleting a name are handled through a support request, so that we can check the request is genuine.
We may suspend or cancel a name, with notice where we can give it, if it is used unlawfully or abusively, if you break these terms, or if the registry requires it.
8. Liability, law and contact
To the extent the law allows, our liability for the domain service is limited to the fees you paid us for that name, and we are not liable for indirect loss such as lost business or traffic. Nothing here limits a liability that cannot be limited by law.
These domain terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have jurisdiction.
